1. Prohibited Uses (Limitations of Use)

By using our platform and/or services, you hereby agree to yourself that you will (i) not collect any information from other users, (ii) reverse engineer and/or interfere with the software of the mobile application, (iii) knowingly or negligently use our services that abuses or disrupts our networks, user accounts or any third party that is involved, (iv) not engage or encourage any illegal activity through this mobile application, (v) use the application in violation of applicable laws or regulations, (vi) harvest, collect, or gather user data without consent, (vii) or transmit any material on this mobile application that may infringe the intellectual property, privacy or other rights of the users and third parties that may be using these services.

2. Intellectual Properties

You as a user, acknowledge that we or our licensors retain all proprietary right, title and interest in the services, our name, our logo and any other related intellectual property rights, including, but not limited to all modifications, enhancements, derivative works and upgrades thereafter. You agree that you will not use or register any trademark, service mark, business name, domain name, or social media account name or handle which incorporates in whole of ASAPP. You wholly agree to comply with our branding guidelines (https://www.asapp-app.com/terms-conditions) which are incorporated into this agreement by reference.

4. Service Provided
ASAPP is an application that allows you to pre-order at coffee shops and restaurants. Once you place an order, the caterer will receive it and will either accept or reject your order. Once you place an order, the caterer will be responsible for accepting and executing it, hence will evaluate the time needed to prepare your order and deliver it to your car. The caterer assumes all liability and obligations relating to the safety and health specifications of the food and beverages that will be sold through ASAPP. ASAPP will not be held liable for the quality of the food and beverages and will only act as a platform to place orders for the Caterer’s food and beverages.

5. Payment Clauses

5.1 Fees & Payment

As a user, you agree to pay all applicable, undisputed fees for the services on the terms set forth on the invoice from your order. You are responsible for all payments, fees and charges that are imposed by your data transmission via your device. You are responsible for providing accurate and current billing, contact and payment information to us and our third party collaborators. You agree that we may take steps to verify whether your payment method is valid, charge your payment card or bill you for all the amounts due for your use of our services.You agree that your credit card information and related personal data may be provided to third parties for payment processing and fraud prevention purposes. We may suspend or terminate your services if at any time we determine that your payment information is inaccurate or not current, and you will be responsible for fees, and overdraft charges that we may incur when we charge you card for payment. We reserve the right to update the price for our services at any time after you register an account with ASAPP Smart Solutions LLC. We will notify you of any price changes via email.

5.2 Payment Methods

Customer bindingly chooses the payment method when placing the respective order, provided that the customer chooses an online payment method, the payment will be processed by a third party online payment gateway provider that is legally cooperating with ASAPP Smart Solutions. The user's card data will be saved in full discretion for future orders by the third party online payment gateway provider, on the condition that the user has given consent to the storage and future usage.

If you have chosen to pay digitally with credit or debit card option on the ASAPP platform then the transaction is processed by the third party payment gateway provider on the ASAPP platform and ASAPP acts as merely an agent of the shop and not at the capacity of a financial institution or intermediary. To further clarify, you can use the ASAPP service and pay by (i) credit card or debit card online through ASAPP or pay by cash or credit card via POS system provided by the vendor at the time of collecting your items. You understand, accept and agree that the online payment facilitation provided by ASAPP on its platform is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online payment gateway for easier payments and faster checkouts. Further, by providing payment facility, ASAPP is neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price that is done by the user.

As the user, you acknowledge and agree that ASAPP acts as the vendor's partner for the limited purpose of accepting payments from you on behalf of the vendor. Upon your payment of amounts to ASAPP, which is due to the vendor, your payment obligation to the vendor for such amounts is completed, and we are responsible for remitting such amounts, to the vendor. To further clarify, the payment is made directly to ASAPP and is subsequently passed on by ASAPP to the vendor. We are authorized by our partner to accept payments on their behalf and payment of the price of any product.

5.3 Refunds

Your satisfaction is our top priority and we aim to provide the best service possible to you. Any and all payments you make to us for access to our services are only refundable if the full service has been incomplete, you may not ask for a refund if you are dissatisfied with the order or the manner in which our services have been brought forth. If an order has been canceled by you or rejected by the caterer, you will receive a full refund on your order. Kindly be informed that the refund into your bank account will take 1 to 2 weeks from when it is processed.

5.4 Exchanges

In the case that an item that you order is unavailable after your payment has been processed, the caterer has the ability to exchange the item for something else of the same price range. If you do not want an exchange, you will receive a refund for the amount of the unavailable item. This must be communicated to the caterer who will then inform ASAPP about the exchange to process the refund. Kindly be informed that the refund into your bank account will take 1 to 2 weeks from when it is processed.

5.5 Order Cancellation

You have the option to cancel your order, before the caterer accepts it. In the case that you cancel your order, you will receive a full refund which will be deposited into your bank account. Kindly be informed that the refund into your bank account will take 1 to 2 weeks from when it is processed.

5.6 Rejected Orders

The caterer has the right to reject any order due to justifiable reasoning. In the case that the caterer rejects your order, they will call you to explain the reason and you will also receive a full refund which will be deposited into your bank account. Kindly be informed that the refund into your bank account will take 1 to 2 weeks from when it is processed.

5.7 Sales, Promotional Offers, Coupons & Pricing

Sales, promotions and other discounted offers are temporary and include but are not limited to such discount pricing offers that have an expiration date. We reserve the right to discontinue and modify any promotional offers, coupons and discounts in our sole discretion.

6. Limitation of Liability and Warranties

You agree that ASAPP Smart Solutions LLC will, in no event be liable for any consequential, incidental, indirect, special, punitive or other loss or damage whatsoever or for loss of business profits, business interruption, computer failure, loss of business information or other loss arising out of or caused by your use of or inability to use the service, even if ASAPP Smart Solutions LLC has advised of the possibility of such damage. In no event shall ASAPP Smart Solutions’s LLC entire liability to you in such respect or any service, whether direct or indirect, exceed the fees paid by you towards such service.

7. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the State of Qatar and all parties submit to the non-exclusive jurisdiction of the courts of this State.
